Red Loft LLP (company number OC301687) registered in England & Wales and whose registered office is at Red Loft LLP, Fifth Floor, Crystal Gate, 28-30 Worship Street, London EC2A 2AH are committed to protecting your privacy and keeping any personal data you provide to us confidential at all times, in accordance with UK data protection laws. This Privacy Notice sets out the information processing activities that Red Loft LLP carries out in its capacity as data controller, and, where relevant, as a data processor acting on behalf of clients or other third parties in accordance with their instructions.

All personal data collected by Red Loft LLP is processed in compliance with the requirements of the UK General Data Protection Regulation, the UK Data Protection Act 2018 and any other relevant legislation such as the Privacy and Electronic Communications Regulation 2003 (PECR).

How is your information collected?

Personal data is any information about an individual from which that person can be identified. The personal information that we may collect about you broadly falls into the following categories:

Information that you provide voluntarily

We may process and store information that you have provided voluntarily. For example, when you get in touch with us through our website you will be asked to provide us with your name, email address and your message. It will be clear to you at this point what personal data you are providing.

Information that we obtain from third party sources

From time to time, we may obtain personal information about you from third party sources (such as web portals that you have registered with, or housing providers), but only where we have checked that these third parties either have your consent or are otherwise legally permitted or required to disclose your personal information to us.

Additionally, property sales portals (such as Rightmove and Zoopla) and social networks (such as Facebook and Instagram) may pass your information onto us where you have given them permission to do this and registered your interest through an advertisement on one of their websites.

Special categories of personal data

"Special categories" of personal data require higher levels of protection. We need to have further justification for collecting, storing and using this type of personal information. We have in place an appropriate policy document and safeguards which we are required by law to maintain when processing such data. We may process special categories of personal information in the following circumstances:

in limited circumstances, with your explicit written consent;
where we need to carry out our legal obligations in field of employment/social security law;
where there is a substantial public interest with a basis defined by the Data Protection Act 2018.

Less commonly, we may process this type of information where it is needed in relation to legal claims or where you have already made the information public.

There are generally no adverse effects for you if you choose not to provide your personal information. Personal information about other people that you provide us

If you give us information on behalf of someone else, you confirm that the other person has appointed you to act on his/her behalf and that:

They have given their consent for their details to be passed to the relevant Red Loft LLP;
You will pass on a copy of this Privacy Policy to them.

International data transfers

We store your personal information on secure servers located in the UK and Europe. We do not intend to transfer your personal information outside the UK or European Economic Area (EEA) unless it is necessary for the operation of our services.

If we do transfer your personal information outside the UK or EEA, we will ensure that appropriate safeguards are in place in accordance with applicable data protection laws. These safeguards may include adequacy regulations, the International Data Transfer Agreement (IDTA) the UK Extension to the EU–US Data Privacy Framework, or standard contractual clauses to ensure your personal information remains adequately protected.

Where you are located outside the UK or EEA, your personal information may be transferred to the UK or Europe, where our systems and service providers are located. This may involve your data being transferred back to your country of origin when we communicate with you (for example, when we respond to emails or correspondence).

How long will we hold information about you?

Your personal information will be deleted when it is no longer reasonably required for the relevant purposes and we are not legally required or otherwise permitted to continue storing such information. Red Loft will, in particular, retain your personal information where required for us to assert or defend legal claims until the end of the relevant retention period or until the claims in question have been settled.

We are also bound by and adhere to anti-money laundering legislation.

The criteria that we use to assess how long to hold your personal information for in our sales and marketing database is a combination of whether or not you have previously purchased using Red Loft and when you last interacted with us. Where you have not purchased a property via us, if we have not had any interaction with you in six months then we will remove your information from our sales and marketing database. This does not affect your rights in relation to your information.

Where you have purchased a property via us, your information will be retained as necessary for the performance of ongoing contractual and legal obligations will have been entered into. Further information on this will be provided at the time of purchase.

Direct Marketing:

Where you have expressly given us consent, we may send you information about new property developments and or services that may be of interest to you. We will only do this where you have agreed to it and use your preferred methods of communication.

We will do our best only to send you information about news, offers and the latest properties that could be suitable for you. To help with this we will ask for information about you - the more we know about the type of property you are interested in, the easier it will be for us to find the right property for you.

You can unsubscribe/withdraw your consent and ask us to stop sending you marketing materials at any time by using the 'unsubscribe' link at the bottom of marketing emails, by informing one of our sales consultants (with whom you have previously been dealing), or through our website.

We keep a record of when we receive consent from individuals and regularly review consent to check updates to preferences. We act on withdrawals of consent as soon as we can. Please note, if you ask us to stop marketing to you, then you will cease receiving marketing from Red Loft LLP.

Service communications

We may send you certain communications, without your consent, if we are under a legal obligation to do so; if we feel sending the communication is in both yours and our interests; and/or it would be a disadvantage to you if we didn’t send you the communication.

Please note however that the withdrawal of your consent will not affect any use of the data made before you withdrew your consent, and we may still be entitled to hold and process the relevant personal information to the extent that we are entitled to do so on bases other than your consent. Withdrawing consent may also have the same effects as not providing the information in the first place, for example we may no longer be able to provide certain services to you.

Your right to object to direct marketing - Where your personal data are processed for direct marketing purposes, you have the right to object at any time to processing of your personal data for marketing, which includes profiling to the extent that it is related to such direct marketing.

Your also have the right to object to and not to be subject to a decision based solely on automated processing including profiling. We do not carry out automated processing or profiling.

Please note that we may ask for proof of your identity and address (such as a copy of your driving license or passport - please do not send any original documents).

For example, you will not be able to request that we delete all of your information if you have purchased a property from us because it will be necessary for the contract you have entered into. We will always let you know the legal basis for this.

We reserve the right to charge you a reasonable administrative fee for any manifestly unfounded or excessive requests concerning your access to your information, and for any additional copies of the personal information, you request from us.

Making a complaint

If you have any concerns about how your personal data is handled, you can raise this with Red Loft in the first instance. We encourage you to contact us so that we can investigate the issue and try to resolve it promptly and fairly.

You can make a complaint by contacting us (see 'How can you contact us?' below). We will acknowledge your complaint and aim to respond within a reasonable timeframe, explaining the outcome of our investigation and any action taken.

If you are not satisfied with our response, or you believe your data protection rights have not been upheld, you have the right to complain to the Information Commissioner’s Office (ICO), the UK’s independent regulator for data protection.
